LAGOS, NIGERIA — The Nigerian Civil Aviation Authority (NCAA) has stressed the need for effective economic regulation in the aviation sector to prevent abuse of market power, promote fair competition and protect consumers.
The Authority said regulation was necessary to balance commercial viability with public interest, particularly amid challenges such as high operating costs, multiple charges, inadequate infrastructure, limited competition and consumer complaints.
Speaking during a discussion on aviation regulation, the NCAA explained that Nigeria’s aviation value chain comprises the government, regulators, airports, air navigation service providers, ground handlers and airlines, each with distinct responsibilities in the development of the sector.
According to the Authority, the government sets policy direction, creates an enabling environment and establishes national priorities for aviation growth, while regulators are responsible for enforcing rules relating to safety, security, economic regulation and consumer protection.
Airports, it said, provide critical infrastructure and facilities for aircraft operations, while air navigation service providers ensure the safe, efficient and seamless movement of aircraft in the nation’s airspace.
Ground handling companies provide essential services that support aircraft operations and maintenance, while airlines connect people, businesses and economies through air transport services.
The NCAA noted that the sector continues to face significant operational challenges, including high fuel and diesel costs, expensive materials, multiple charges and inadequate infrastructure.
It said effective regulation would help ensure fair pricing, prevent the abuse of dominant market positions, encourage investment in aviation infrastructure and protect the rights of passengers.
The Authority further noted that investors require predictable returns, transparent regulations and fair access to infrastructure, while airlines need fair access and transparent charges. Consumers, on the other hand, expect safe, affordable and quality air transport services.
The NCAA said the regulatory framework established under the Nigeria Civil Aviation Act 2022 provides the legal foundation for regulating economic activities, consumer protection, market entry, airline licensing, air transport competition, charges, tariffs and fair access to aviation infrastructure.
It added that the regulatory framework was designed to create a stable investment environment, promote fair competition, improve service quality and protect consumers from possible abuses by dominant operators.
On economic licensing, the Authority said the process was designed to ensure transparent licensing, assess the financial fitness of operators, promote market sustainability and prevent anti-competitive practices.
It explained that prospective airlines must meet established requirements, including the presentation of a viable business plan, before being allowed to commence operations.
The NCAA said the licensing process was necessary to protect both investors and consumers by ensuring that operators entering the market had the capacity to provide sustainable services.
On consumer protection, the Authority said regulations were in place to safeguard passenger rights and ensure that airlines complied with minimum service standards.
It said passengers were entitled to relevant information about their flights and appropriate remedies where services were cancelled or disrupted.
The Authority also highlighted the importance of economic oversight, saying airlines were required to submit financial returns and other relevant information to support transparency, accountability and regulatory compliance.
It further stated that competition regulation was necessary to prevent discriminatory practices and promote a level playing field among aviation operators.
The NCAA said airports and other aviation service providers were expected to meet established standards, comply with applicable regulations and undergo regular audits and inspections.
According to the Authority, identified deficiencies must be addressed through corrective action plans, while service providers are expected to maintain minimum service levels to ensure safety and efficiency.
The Authority also emphasised the importance of regulating air navigation services, noting that reliable navigation services were essential to the safe and efficient operation of the aviation industry.
It said service providers were expected to meet established performance and safety requirements, with penalties applicable where service obligations were not met.
The NCAA stressed that regulation without enforcement would be ineffective, adding that the Authority had the power to conduct audits and inspections, impose sanctions and suspend or withdraw licences where necessary.
It said enforcement actions were essential to ensuring compliance and maintaining safety and accountability across the aviation sector.
The Authority added that effective economic regulation could promote non-discriminatory access, service-level agreements and published performance standards to improve fairness, efficiency and accountability in the industry.
It said the benefits of effective regulation would extend to all stakeholders, with investors gaining predictable returns, airlines enjoying greater transparency and reduced operational disruptions, and consumers receiving safer, more reliable and better-quality services.
The NCAA concluded that a competitive and sustainable Nigerian aviation industry could not be achieved through monopoly, but through effective regulation, fair competition, investment and consistent enforcement of established rules.
